1. Introduction
These Terms of Use (“Terms”) govern access to and use of the EasyMLS AI Estimator platform, the website aiestimator.org, related APIs, and associated services (the “Service”) operated by EasyMLS Yachting, LLC. By creating an account or using the Service, you agree to comply with these Terms. If you do not agree, you must discontinue use of the Service.
2. Description of the Service
EasyMLS AI Estimator is a SaaS platform that generates AI-assisted market valuation reports for pleasure boats and yachts based on vessel characteristics provided by the user and publicly available comparable-listing data. The Service produces estimates and analyses for informational purposes only and does not constitute a survey, appraisal, financial advice, brokerage recommendation, or legally binding valuation. EasyMLS Yachting, LLC is a technology provider and does not act as a broker, surveyor, appraiser, agent, or marketplace intermediary.
3. User eligibility
Users must be at least 18 years old and provide accurate information during registration.
4. Account registration
Accounts use passwordless authentication (magic link / one-time code sent by email). You are responsible for protecting access to the email address linked to your account and for activities conducted through your account. EasyMLS Yachting, LLC is not liable for unauthorized account access caused by user negligence.
5. Use of estimations
Estimations produced by the Service are AI-generated, indicative, and based on the inputs you provide and publicly available data. They are not appraisals, surveys, or guarantees of market value. You are solely responsible for any commercial, financial, or legal decision you make on the basis of an estimation, and you should obtain a professional survey or appraisal before any transaction. EasyMLS Yachting, LLC accepts no liability for losses arising from reliance on an estimation.
6. Artificial intelligence
The Service uses third-party AI models (including OpenAI) to generate report text and analysis. Users remain responsible for reviewing AI-generated content before using or sharing it. EasyMLS Yachting, LLC is not liable for errors, omissions, or inaccuracies produced by AI systems.
7. Data protection and privacy
EasyMLS Yachting, LLC processes personal and vessel data in accordance with its Privacy Policy.
8. Subscription and fees
The Service is offered on a pay-per-estimate and/or subscription basis. Fees, billing terms, and any free-tier limits are displayed at the point of purchase. Payment is processed by Stripe, Inc. and subject to the Stripe Services Agreement. Subscriptions may be cancelled in accordance with the conditions published on the pricing page.
9. EU consumer 14-day withdrawal
If you are a consumer domiciled in the European Union or the United Kingdom, you have the right to withdraw from a paid subscription within fourteen (14) calendar days of sign-up, without giving any reason and without penalty, under the Consumer Rights Directive (2011/83/EU) and equivalent national implementations. To exercise this right, send a clear statement of withdrawal to info@easymls.com before the 14-day period expires. If you expressly consent to immediate performance of the Service during the 14-day period, the withdrawal right is lost once the Service has been fully performed; for partially consumed subscriptions, a pro-rated amount remains due.
10. Acceptable use
You agree not to:
- submit fraudulent or knowingly inaccurate vessel data;
- violate applicable laws;
- disrupt platform operations or attempt unauthorized data extraction;
- upload illegal or copyrighted material without permission;
- resell, redistribute, or systematically scrape estimations generated by the Service.
Violations may result in account suspension or termination. EasyMLS Yachting, LLC reserves the right to remove content suspected of fraud, misrepresentation, or unauthorized use.
11. Intellectual property
All EasyMLS AI Estimator technology, code, prompts, databases, branding, design, and architecture remain the property of EasyMLS Yachting, LLC. You may not copy the platform, reverse engineer the system, or reproduce software components. The estimation report text generated for your inputs is provided for your own use.
12. Platform availability
EasyMLS Yachting, LLC aims to maintain high service availability but does not guarantee uninterrupted operation. Interruptions may occur due to maintenance, security updates, or external provider failures.
13. Limitation of liability
The Service is provided “as is” without warranties of any kind. EasyMLS Yachting, LLC is not liable for: inaccuracies in AI-generated estimations; financial or commercial decisions made in reliance on an estimation; lost sales opportunities; or losses arising from third-party service outages.
14. Indemnification
You agree to indemnify EasyMLS Yachting, LLC against claims arising from: inaccurate or unlawful data you submit; intellectual property violations; or misuse of the Service.
15. Termination
EasyMLS Yachting, LLC may suspend or terminate accounts that violate these Terms, misuse the Service, or create technical risks. You may request account deletion at any time by contacting info@easymls.com.
16. Governing law
These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be handled within the jurisdiction of Florida courts unless otherwise required by law.
17. Updates to the Terms
EasyMLS Yachting, LLC may update these Terms periodically. Updated versions will be published on aiestimator.org. Continued use of the Service indicates acceptance of the updated Terms.
